Frederick County Circuit Court Records

The Frederick County Circuit Court Clerk handles all court records for civil and criminal cases filed within the county. Court records are public under Virginia Code § 17.1-208. Anyone can view filed documents, docket entries, case outcomes, and orders. The courthouse is located in Winchester, though it serves Frederick County and not the independent City of Winchester, which has its own separate court.

You can search Frederick County court cases online using the Virginia Circuit Court Online Case Information System. Select Frederick County from the available court list. Search by party name, case number, or hearing date. The system shows party information, docket history, and case status in real time. For the actual filed documents, public access computers at the courthouse let you view scanned records for most current cases.

Frederick County is in the 26th Judicial Circuit. The circuit also covers the City of Winchester and other nearby independent cities. Because Virginia independent cities are separate legal jurisdictions, records for events that happened in Winchester are at the Winchester Circuit Court, not Frederick County. Frederick County Land Records

Property records for Frederick County are filed with the Circuit Court Clerk. This includes deeds, deeds of trust, plats, UCC filings, wills, marriage licenses, and judgment liens. The Virginia Secure Remote Access (SRA) system offers online access to these records. After registering, you can search Frederick County land records by name, document type, or date range. Coverage goes back to the dates the county joined the system, with older records handled separately.

Deeds show who owns what property and when it transferred. Deeds of trust reflect mortgage debt secured against real estate. Plats document subdivision layouts and are useful when checking property boundaries. For very old records, the Library of Virginia holds chancery records from 1804 through 1951, and its digital collections include historical land and probate documents from across Virginia.

Frederick County FOIA Requests

All Frederick County government offices are subject to Virginia's Freedom of Information Act. Under § 2.2-3700, public records are presumed open. The county can only deny a request if a specific statutory exemption applies, and those exemptions are read narrowly in favor of access. You do not need to cite FOIA when submitting a request.

Direct requests to the Frederick County Administrator's office or the specific department that holds the records. The county must respond within five working days under § 2.2-3704. They can take up to seven more days if needed, but they have to notify you right away if that is the case. Vital Records

Birth, death, marriage, and divorce records for Frederick County events are centrally maintained by the Virginia Department of Health, Office of Vital Records. All requests go to the state office in Richmond, not to Frederick County offices. Certified copies cost $12 each and require a valid photo ID.

Statutory access rules at § 32.1-272 and §§ 32.1-254 and 32.1-255 limit who can request vital records. Eligible requestors are the person named, their spouse, parent, child, sibling, or grandparent. Birth records open to the public after 100 years. Death, marriage, and divorce records go public after 25 years. Criminal Records

Virginia criminal history records are held by the Virginia State Police through the Central Criminal Records Exchange. Under § 19.2-389, you can request your own criminal history by writing to Department of State Police, P.O. Box 85076, Richmond, VA 23261-5076. Access to other people's records is limited by law to specific authorized entities and circumstances.
